Vows 2 Vintage LLC
This Buyer Agreement governs your purchases through Vows2Vintage. It is part of the Terms of Service. Section 6 explains the 3-day inspection period and Section 7 explains what does and does not qualify for a refund. Please read both before you buy.
1. Who You Are Buying From
Vows2Vintage is a marketplace. Unless a Listing says an item is sold by Vows2Vintage, you are buying from an independent seller, not from Vows2Vintage.
For every item you buy from a Seller:
- The contract of sale is between you and the Seller.
- The Seller owns the item and is responsible for describing it accurately, for its condition and authenticity, and for packing and shipping it.
- We collect your payment on the Seller's behalf, as described in Section 5.
- We do not own, hold, inspect, authenticate, or handle any item.
- We do not guarantee any item, and we make no warranty about any item.
Unless a Listing says otherwise, items are sold "as is" and "with all faults." Most items on Vows2Vintage are pre-owned. Read the Listing carefully.
2. Eligibility
You must be at least 18 to buy. You must provide accurate account and shipping information and maintain a valid payment method.
3. Before You Buy
You are responsible for reading the Listing. Before you purchase, please:
- read the full description, including every disclosed flaw, alteration, and repair;
- look at every photograph. The first photograph on every Listing must be a real photograph of the item. Styled images are labeled as styled, and manufacturer or designer images are labeled as such;
- check the measurements against your own, rather than relying on the size label, because sizing varies by brand, by era, and after alteration. Measurements on a Listing are taken by the Seller with a tape measure, with the item laid flat;
- if a Listing gives only the designer's size, use the designer's size chart linked from the Listing. Neither we nor the Seller promise how that item will fit you;
- if a Listing says the designer is unconfirmed, read the Seller's reason for believing who made it, and decide whether you are comfortable with it;
- check whether the item has been altered, worn at an event, or cleaned;
- check the condition grade and what it means; and
- ask the Seller any question you have, through the Services, before you buy.
What the Seller tells you in messages through the Services before you buy, about the item's measurements, condition, or other facts, counts as part of the Listing.
Wedding timelines are tight. If you need an item by a specific date, ask the Seller about handling time and shipping time before you purchase.
4. Prices
The price you see is the price you pay for the item. We do not add mandatory buyer fees at checkout. Only the following are added at checkout:
(1) sales tax and other taxes or fees imposed by a government on the transaction; and
(2) on Listings where you pay shipping, the postage quoted at checkout, which is the actual carrier cost of shipping the item.
If we offer optional extras that you can decline and still complete your purchase, they are shown separately before you pay.
5. Placing an Order
When you place an order, you authorize us and our payment processor to charge your payment method. Your order is confirmed when your payment clears.
You pay Vows2Vintage as the Seller's limited payment collection agent. When your payment clears, your obligation to pay the Seller for the item is satisfied, whether or not we have yet paid the Seller.
We hold your payment and do not release it to the Seller until the earlier of your confirming that you are happy with the item or the end of the inspection period in Section 6. If you open a claim or an appeal, we continue to hold the payment until it is decided.
If the Seller cancels or cannot fulfil your order, you receive a full refund to your original payment method.
When your order is confirmed, we buy the shipping label. The Seller must drop the package off with the carrier, using that label, within 3 business days, unless the Listing states a longer handling time.
6. Your 3-Day Inspection Period
This is the most important date in your transaction. Please read it.
When your order is delivered, you have 3 calendar days to inspect it and open a claim if something is wrong. The 3 days begin when the carrier records delivery.
During the inspection period you should:
- open the package and inspect the item promptly;
- compare it against the Listing description, the photographs, the measurements, and anything the Seller told you in messages;
- take photographs of any problem, and of the packaging and shipping label, before you do anything else; and
- open a claim as described in Section 8 if the item qualifies under Section 7.
Do not wear, alter, clean, or use the item during the inspection period if you think you may have a claim. Once an item has been worn at an event, altered, or cleaned, it can no longer be returned.
If you do not open a claim within 3 days, the sale is final and your payment is released to the Seller. You may confirm that you are happy with the item earlier, which releases payment to the Seller sooner.
7. What Qualifies for a Refund, and What Does Not
7.1 Qualifying issues
You may open a claim if:
- the item was never delivered;
- the item is significantly not as described, meaning it differs materially from the Listing in brand, size, color, material, condition, or measurements;
- a measurement the Seller took with a tape measure differs from the item by more than one-half inch, measured flat;
- the photographs on the Listing are not photographs of the item you received, or were generated or altered, by artificial intelligence or any other tool, so that the item looks different from what you received;
- the item has an undisclosed flaw, stain, tear, repair, alteration, or damage that a reasonable buyer would consider material;
- the item is counterfeit or is an unauthorized replica, even if the Listing said the designer was unconfirmed;
- the Listing said the designer was unconfirmed, and the reason the Seller gave for believing who made the item was false;
- the item arrived damaged in transit;
- you received the wrong item; or
- a major component that the Listing said was included is missing.
For this Section, the Listing includes what the Seller told you in messages through the Services before you bought, as described in Section 3.
7.2 Non-qualifying issues
The following do not qualify for a refund or return:
- the item does not fit, or you ordered the wrong size, including where the Listing gave only the designer's size;
- a measurement differs from the item by one-half inch or less, measured flat;
- the item turns out not to be by the designer the Listing named as unconfirmed, unless the item is counterfeit or the Seller's stated reason was false;
- you changed your mind, or you no longer want the item;
- your event was cancelled, postponed, or changed;
- you found the item cheaper somewhere else;
- the color looks different on your screen than in person, where the difference is caused by screen settings, lighting, or photography;
- normal wear that was disclosed in the Listing or is visible in the photographs;
- a flaw that the Listing disclosed;
- you did not read the description or the measurements;
- you had the item altered, cleaned, or repaired after delivery;
- you wore the item at an event; or
- you opened your claim after the inspection period ended.
We do not currently offer returns for reasons other than the qualifying issues in Section 7.1.
7.3 Final sale items
Items that are custom made, made to order, monogrammed, personalized, or altered to your measurements are final sale and cannot be returned unless they qualify under Section 7.1. Items graded Fair or Poor are final sale. Listings marked "final sale," "as is," or "no returns accepted" are also final sale. In each case, a qualifying issue in Section 7.1 still applies.
8. How to Open a Claim
Open a claim within the 3-day inspection period in any of these ways:
- using "Open a Claim" on your order page, where available;
- by emailing help@vows2vintage.com; or
- by replying to any email we sent you about the order.
Putting "Claim" and your order reference in the subject line helps us find your order faster, but it is not required. A message that reaches us within the 3 days and tells us something is wrong with your order opens a claim.
You will be asked to:
(1) tell us the reason for the claim;
(2) describe the problem; and
(3) send clear photographs within 2 days of opening the claim, showing the problem, the whole item, any label or tag, the packaging, and the shipping label. You can upload them on your order page, where available, or attach them to an email.
We will notify the Seller, who has 3 days to respond. The Dispute Resolution Policy explains what happens next, how we decide, and how to appeal.
9. Returns and Refunds
If a claim is approved and a return is required, you must ship the item back within 3 days of approval, using the return label we provide, in the same condition you received it, with all tags, components, and original packaging. Keep proof of shipment.
Approved refunds are issued to your original payment method. We will process a refund within 5 business days of approval, or within 5 business days of the Seller receiving an approved return, whichever applies. Your bank or card issuer controls when the money appears in your account, which usually takes 5 to 10 business days.
If your claim is approved, you do not pay return shipping.
10. Shipping and Delivery
- Check that your shipping address is correct before you pay. We cannot change it once your order is confirmed and the shipping label is bought.
- Track your package and be available to receive it. Tracking comes from the carrier's own scans.
- If tracking shows delivered but you did not receive the package, check with your household, your neighbors, and your building, then open a claim within the inspection period.
- If a package is lost in transit, open a claim and we will work with the Seller and the carrier.
- Risk of loss passes to you on delivery.
The Shipping Policy has more detail.
11. Communication
Communicate with Sellers through the Services. Messages sent through the Services are our record if a dispute arises, and what a Seller tells you in them before you buy counts as part of the Listing. Do not move a transaction off the Services. If you do, you lose every protection in this Agreement and in the Refund, Return and Buyer Protection Policy, and we cannot help you.
12. Your Conduct
You must not:
- submit a false, exaggerated, or fraudulent claim;
- claim an item was not as described in order to obtain a free return after wearing or using it;
- return a different item, a damaged item, or an empty package;
- file a chargeback without first opening a claim with us and allowing us to resolve it;
- use a stolen or unauthorized payment method;
- harass, threaten, or abuse a Seller or our staff;
- post or threaten to post anything false about a Seller, or use any public comment to pressure a Seller into a refund outside this Agreement; or
- open a pattern of claims that indicates abuse of the claim process.
We may restrict, suspend, or terminate your account, decline your claims, and pursue recovery of any amount you obtained improperly, if you do any of these things. Where a claim is fraudulent, we may report it to the payment provider and to law enforcement.
13. Chargebacks
If you believe something is wrong with your order, open a claim with us first. Our claim process is faster than a chargeback and does not put your account at risk.
If you file a chargeback while a claim is open, we may pause the claim until the chargeback is decided. If you file a chargeback for a reason that does not qualify under Section 7.1, or after receiving a refund, we may restrict or terminate your account and recover the amount from you.
14. Reporting a Problem
You can report a Listing, a Seller, suspected counterfeit goods, suspected stolen goods, or any other concern:
- by email to help@vows2vintage.com;
- by telephone at (949) 627-8692; or
- using the report link on any Listing page.
15. Privacy
Our Privacy Policy explains how we handle your information. Your name and shipping address are shared with the Seller and the carrier, and printed on the shipping label, so your order can be delivered. Sellers may use that information only to fulfil your order.
16. Disclaimers and Limitation of Liability
Sections 15 and 16 of the Terms of Service apply to this Agreement, including the carve-outs in Section 16.3 of those Terms. Nothing in this Agreement limits our liability for fraud, intentional or negligent misrepresentation, willful injury, gross negligence, violation of law, or death or personal injury caused by our negligence.
17. Dispute Resolution
Section 20 of the Terms of Service, Dispute Resolution and Arbitration, applies to any dispute between you and us, including your right to opt out within 30 days. Section 19 of those Terms, which requires a claim to be brought within one year, also applies. Disputes between you and a Seller about an item are handled under the Dispute Resolution Policy.
18. Changes
We may update this Agreement as described in Section 22 of the Terms of Service. Changes apply only going forward and do not affect a transaction you have already completed.
