Vows 2 Vintage LLC
Vows2Vintage respects intellectual property rights and expects our users to do the same. This Policy explains how to report copyright infringement, trademark infringement, and counterfeit goods, how a user can respond, and what happens to repeat infringers.
1. What Is Not Allowed
- Listing or selling counterfeit goods, unauthorized replicas, or reproductions
- Using another party's trademark, logo, brand name, or character in a Listing, in signage, or on merchandise without authorization
- Using photographs, text, or designs you do not own and are not licensed to use
- Using another seller's photographs or listing text
- Using a person's name, image, or likeness for commercial purposes without permission
- Describing an item as a brand it is not, or as "inspired by" or "dupe" in a way that trades on another party's mark
2. Reporting Copyright Infringement
2.1 Where to send a notice
Send copyright notices to our designated agent:
- Designated Agent: Kathy Gorman, Chief Executive Officer
- Email: copyright@vows2vintage.com
- Mail: Vows 2 Vintage LLC, Attn: Copyright Agent, 25422 Trabuco Road, STE 105-356, Lake Forest, CA 92630
- Telephone: (949) 627-8692
2.2 What the notice must contain
To be effective, a written notice must include:
(a) a physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf;
(b) identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice;
(c) identification of the material claimed to be infringing, with enough detail for us to locate it, such as the Listing URL;
(d) your name, address, telephone number, and email address;
(e) a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
(f) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorized to act on the owner's behalf.
An incomplete notice may delay or prevent action. Knowingly making a material misrepresentation in a notice may expose you to liability for damages, including costs and attorneys' fees.
2.3 What we do
When we receive a complete notice we will remove or disable access to the material expeditiously, notify the user who posted it, and give that user a copy of the notice.
3. Counter-Notice
If your content was removed and you believe the removal was a mistake or a misidentification, you may send a counter-notice to the agent above. It must include:
(a) your physical or electronic signature;
(b) identification of the material that was removed and the location where it appeared before removal;
(c) a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;
(d) your name, address, and telephone number; and
(e) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which Vows 2 Vintage LLC may be found, and that you will accept service of process from the person who submitted the notice or that person's agent.
We will forward the counter-notice to the person who submitted the original notice. Unless that person notifies us within 10 business days that they have filed an action seeking a court order to restrain the activity, we may restore the material in 10 to 14 business days.
4. Reporting Trademark Infringement or Counterfeit Goods
Trademark and counterfeit reports are handled separately from copyright notices. Send them to copyright@vows2vintage.com with the subject line "Trademark Report" or "Counterfeit Report" and include:
- your name, company, address, telephone number, and email address;
- the trademark at issue, including the registration number and jurisdiction if registered;
- your relationship to the rights holder and your authority to act;
- the Listing URL or a screenshot;
- a clear explanation of why the Listing infringes or why the item is counterfeit, including the specific indicators you relied on; and
- a statement that you have a good faith belief that the use is not authorized and that the information you provided is accurate.
We may ask for further information. We remove Listings we determine to be infringing or counterfeit, and we act on the seller's account under Section 6.
5. Right of Publicity and Privacy
If a Listing uses your name, photograph, or likeness without your permission, write to copyright@vows2vintage.com with the Listing URL and an explanation. We will review and act where appropriate.
6. Repeat Infringer Policy
We terminate the accounts of repeat infringers in appropriate circumstances.
| Occurrence | Action |
|---|---|
| First | Listing removed. Written warning explaining the removal and this Policy. |
| Second | Listing removed. Selling privileges suspended for 30 days. Payout hold on related transactions. |
| Third | Account terminated permanently. |
We may terminate an account immediately, without progressing through these steps, where the infringement is willful, where the item is counterfeit, or where the circumstances otherwise warrant it. Selling counterfeit goods results in immediate termination.
A strike is removed from a user's record if a counter-notice is submitted and the material is restored, or if we determine the notice was mistaken.
7. Appeals
If you believe an action under this Policy was taken in error, write to help@vows2vintage.com within 30 days with your explanation and any documentation, including proof of authorization, licensing, receipts, or certificates of authenticity. We will review and respond in writing. Submitting an appeal does not replace the counter-notice procedure in Section 3 for copyright matters.
8. Our Intellectual Property
