Terms of Use

1. Overview

Vows2Vintage is an online marketplace that allows users to list, browse, and sell wedding-related items. During our early access release, only approved sellers may list items for sale. Buyers may browse listings but cannot yet complete purchases.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement to use Vows2Vintage. By creating an account, you represent that all information you provide is accurate and that you are not barred from using the Services under any applicable law.

3. Account Registration and Security

• You must create an account to list or sell items.
• You agree to provide true, current, and complete information and to update it as needed.
• You are responsible for safeguarding your login credentials and all activity under your account.
• Notify us immediately at hello@vows2vintage.com if you suspect unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or our policies.

4. Early Access Limitations

During the early access phase:

• Only sellers approved by Vows2Vintage may create listings.
• Buyers may view listings but cannot complete transactions.
• Payment processing and shipping integrations (Stripe and Shippo) are not yet active.
• Features may change, and user data may be reset as we refine the platform.

By participating in early access, you agree to these limitations and understand that the Services are provided for testing and feedback purposes.

5. Marketplace Role

Vows2Vintage provides a technology platform for users to connect. We are not the buyer or seller in transactions between users. When the marketplace is fully enabled, contracts for sale will be directly between buyers and sellers. We do not guarantee the quality, safety, or legality of items listed or the conduct of users.

6. Acceptable Use

You agree to use the Services lawfully and ethically. You must not:

• Post or sell items prohibited by law or our Community Guidelines.
• Misrepresent any item's description, authenticity, or condition.
• Upload or distribute malware, spam, or automated scraping tools.
• Harass, threaten, or defame other users.
• Circumvent or disable security or payment features.
• Use the platform to collect information about others without consent.

We may remove content, suspend accounts, or take other action if we believe your use violates these Terms.

7. Listing Content

Sellers are responsible for the content they post. This includes photos, descriptions, prices, and other listing information. By posting a listing, you confirm that:

• You own or have the right to sell the item.
• Your content does not infringe any copyright, trademark, or privacy rights.
• You grant Vows2Vintage a limited, non-exclusive, worldwide license to host, display, and promote your listings in connection with the marketplace.

Listings must comply with our Community Guidelines & Prohibited Items Policy available at vows2vintage.com/guidelines.

8. Fees and Payments

When transactions are enabled, sellers agree to pay applicable fees and commissions as described in our fee schedule. Fees may include transaction fees, payment processing charges, and shipping label costs. Fee updates will be posted in advance on our website.

9. Disputes Between Users

Users are responsible for resolving disputes directly with each other. Vows2Vintage may assist in facilitating communication but is not obligated to intervene or mediate disputes. Once payment features are active, any refund or return policies will be published separately.

10. Intellectual Property

The Vows2Vintage name, logo, website design, and all original content are the property of Vows 2 Vintage LLC. You may not copy, modify, or use our intellectual property without written permission.

11. Privacy

Your privacy is governed by our Privacy Policy at vows2vintage.com/privacy, which describes how we collect and use information. By using the platform, you consent to the handling of your data as described there.

12. Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms or any applicable laws. You may terminate your account at any time by contacting hello@vows2vintage.com. Sections that by nature should survive termination, including intellectual property, disclaimers, and limitations of liability, will remain in effect.

13. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. Vows2Vintage makes no warranties or representations of any kind, express or implied, regarding the operation, availability, or accuracy of the Services or any content. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

14. Limitation of Liability

To the fullest extent permitted by law, Vows2Vintage, its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability to you for any claim will not exceed the greater of one hundred dollars ($100) or the amount of fees paid to us in the six months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so these provisions may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Vows 2 Vintage LLC and its affiliates from and against all claims, damages, liabilities, and expenses (including attorneys' fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable laws.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under or related to these Terms shall be brought in the state or federal courts located in Orange County, California. You consent to the exclusive jurisdiction of these courts.

17. Changes to These Terms

We may update these Terms at any time. The revised version will be posted at vows2vintage.com/terms with a new effective date. Continued use of the Services after the effective date means you accept the updated Terms.
